Welcome to Tête-à-Tête. These Terms & Conditions (“Terms”) constitute a legally binding agreement between you and People First Ventures S.L. (“Tête-à-Tête,” “we,” “our,” or “us”), a company incorporated in Madrid, Spain. By accessing or using the Tête-à-Tête mobile application and related services (the “Service”), you agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines.
Please read these Terms carefully. If you do not agree to these Terms, do not use the Service.
Important Notice: Section 14 contains provisions regarding dispute resolution and governing law. By using the Service, you agree that disputes will be resolved in accordance with Spanish law and the courts of Madrid, Spain, unless otherwise required by mandatory consumer protection laws in your country of residence.
1. Eligibility
To create an account and use the Service, you must:
- Be at least 18 years old, or the age of majority in your jurisdiction if higher than 18
- Be legally permitted to use dating services under the laws of your country of residence
- Not have been convicted of any violent crime, sexual offense, or any crime involving fraud or dishonesty
- Not have been previously banned from Tête-à-Tête without written permission to rejoin
- Have the legal capacity to enter into a binding contract
We monitor for underage use and reserve the right to terminate, suspend, or require verification of any account we reasonably believe may be underage or otherwise ineligible.
2. Account Registration & Security
2.1 Account Creation
You may create an account using your email address or through third-party authentication providers. You agree to provide accurate, current, and complete information during registration and to update such information as necessary to keep it accurate.
2.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to:
- Not share your account or login credentials with any other person
- Not create multiple accounts
- Immediately notify us of any unauthorized use of your account
- Use your real name and real age on your profile
2.3 Identity Verification
We may require you to verify your identity at any time to maintain access to the Service. Failure to complete verification requests may result in suspension or termination of your account.
3. Types of Content
The Service contains three types of content:
3.1 Your Content
“Your Content” means all content you upload, post, or transmit through the Service, including photos, profile information, date proposals, messages, and other materials. You retain ownership of Your Content, but by uploading it to Tête-à-Tête, you grant us a non-exclusive, royalty-free, perpetual, worldwide, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display Your Content in connection with operating and improving the Service.
You represent and warrant that you have all necessary rights to grant this license and that Your Content does not infringe the rights of any third party.
3.2 Member Content
“Member Content” means content uploaded by other users. You may only use Member Content for purposes consistent with the Service (meeting people for dates). You may not use Member Content for commercial purposes, harassment, stalking, or any unlawful purpose.
3.3 Our Content
“Our Content” means all content owned by Tête-à-Tête, including the app design, graphics, logos, text, software, and databases. All intellectual property rights in Our Content remain with us. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Our Content solely for your personal, non-commercial use of the Service.
4. Prohibited Content & Conduct
Our Community Guidelines form part of these Terms. You agree not to upload, post, or transmit any content that:
- Is illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory
- Is sexually explicit, pornographic, or obscene
- Depicts or promotes violence
- Is harmful to minors in any way
- Infringes any patent, trademark, copyright, or other intellectual property rights
- Contains another person’s image without their consent
- Impersonates any person or misrepresents your identity
- Constitutes spam, commercial solicitation, or advertising
- Contains viruses, malware, or other harmful code
- Promotes scams, fraud, or deceptive practices
You also agree not to:
- Use the Service for any commercial purpose without our written consent
- Stalk, harass, or harm another user
- Use automated systems, bots, or scrapers to access the Service
- Attempt to gain unauthorized access to the Service or other accounts
- Submit false or malicious reports against other users
5. Safety & User Interactions
5.1 No Background Checks
TÊTE-À-TÊTE DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON ITS USERS. We do not verify the identity, background, or statements of our users. You are solely responsible for your interactions with other users, both online and offline.
5.2 Safety Recommendations
We strongly recommend that you:
- Always meet in public places for initial dates
- Inform a friend or family member of your plans, including the venue and time
- Arrange your own transportation to and from the date
- Trust your instincts—if something feels wrong, leave
- Report any suspicious or harmful behavior to us immediately
5.3 Release of Liability
To the maximum extent permitted by applicable law, you release Tête-à-Tête from any claims, demands, damages, losses, or expenses arising from your interactions with other users, whether online or offline.
6. Account Actions & Enforcement
6.1 Our Rights
We reserve the right, at our sole discretion, to:
- Remove any content that violates these Terms
- Issue warnings to users
- Temporarily or permanently suspend accounts
- Terminate accounts without refund for violations
- Cooperate with law enforcement when required or appropriate
Conduct outside the app may also result in action on your account if we become aware of behavior that is harmful, illegal, or violates these Terms.
6.2 Appeals (EU Digital Services Act)
If you believe we made an error in taking action against your account or content, you may appeal within six (6) months by contacting support@teteatete.co. Please explain why you believe the decision was incorrect and provide relevant details. For users in the European Union, you have additional rights under the Digital Services Act, including the right to access out-of-court dispute settlement processes and to seek remedies in the courts of your EU member state.
7. Account Deletion
7.1 Voluntary Deletion
You may delete your account at any time through the Settings menu in the app. Upon deletion:
- Your profile will be immediately hidden from other users
- You will have a 14-day grace period to restore your account by contacting support
- After 30 days, your personal data will be permanently deleted from active systems
- After 90 days, your data will be purged from backup systems
Account deletion does not automatically cancel any active subscriptions. You must cancel subscriptions separately through the Apple App Store or Google Play Store.
7.2 Data Retention After Deletion
Certain data may be retained after account deletion as required by law or for legitimate business purposes, including transaction records (7 years), fraud prevention data (3 years), and anonymized analytics data (indefinitely). See our Privacy Policy for details.
8. Subscriptions & Payments
8.1 Premium Features
Some features of the Service may require a paid subscription or one-time purchase (“Premium Features”). Prices and available features will be displayed in the app before purchase.
8.2 Payment Processing
Payments are processed through the Apple App Store or Google Play Store (“Third-Party Stores”). Your purchase is subject to the payment terms of the applicable Third-Party Store.
8.3 Auto-Renewal
SUBSCRIPTIONS AUTOMATICALLY RENEW unless you cancel before the end of the current billing period. You will be charged the then-current subscription price upon renewal. To cancel, you must do so through your Third-Party Store account settings—deleting the app does not cancel your subscription.
8.4 Refunds
Refunds are governed by the policies of the applicable Third-Party Store and applicable consumer protection laws. Users in the European Union have a 14-day right of withdrawal for digital purchases, unless you have expressly consented to immediate performance and acknowledged the loss of withdrawal rights.
9. Intellectual Property
All intellectual property rights in the Service, including but not limited to trademarks, logos, trade names, software, designs, text, graphics, and databases, are owned by or licensed to Tête-à-Tête. You may not:
- Copy, modify, or distribute Our Content without written permission
- Use our trademarks or branding without written permission
- Reverse engineer, decompile, or disassemble the Service
- Create derivative works based on the Service
10. Copyright Infringement
If you believe content on Tête-à-Tête infringes your copyright, please send a notice to support@teteatete.co containing:
- Identification of the copyrighted work claimed to be infringed
- Identification of the allegedly infringing material and its location
- Your contact information
- A statement of good faith belief that the use is not authorized
- A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner
11. Third-Party App Stores
If you download the app from a Third-Party Store (Apple App Store or Google Play Store), you acknowledge that:
- These Terms are between you and Tête-à-Tête, not the Third-Party Store
- The Third-Party Store has no obligation to provide maintenance or support for the app
- Tête-à-Tête, not the Third-Party Store, is responsible for addressing claims relating to the app
- The Third-Party Store and its subsidiaries are third-party beneficiaries of these Terms
- In the event of conflict between these Terms and the Third-Party Store’s terms, the Third-Party Store’s terms shall govern with respect to the app download
12. Disclaimers & Limitation of Liability
12.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.
12.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TÊTE-À-TÊTE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, resulting from (a) your use or inability to use the Service; (b) any conduct or content of any user or third party on the Service; (c) unauthorized access, use, or alteration of your content; or (d) any other matter relating to the Service.
In no event shall our total liability exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim, or one hundred euros (€100), whichever is greater.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Tête-à-Tête and its officers, directors, employees, agents, licensors, and partners from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Service
- Your Content
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your interactions with other users, whether online or offline
14. Governing Law & Dispute Resolution
14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law principles.
14.2 Jurisdiction
Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.
14.3 Consumer Rights
If you are a consumer residing in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence, including your right to bring claims in the courts of your country of residence.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the app or email at least 30 days before they take effect, unless a shorter notice period is required by law or necessary to address security concerns. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Tête-à-Tête regarding the Service and supersede all prior agreements and understandings.
16.2 Severability
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions will continue in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
16.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
16.5 Survival
Sections that by their nature should survive termination shall survive, including but not limited to Sections 3 (Types of Content), 5 (Safety), 9 (Intellectual Property), 12 (Disclaimers & Limitation of Liability), 13 (Indemnification), and 14 (Governing Law).
